AED RENTAL AGREEMENT

1. Equipment Rented
By agreeing to these terms, the customer (“Lessee”) is renting one or multiple Automated External Defibrillator (AED) unit(s) from Do CPR (“Lessor”), Model [AED Model, as outlined in the quote provided.
2. Rental Period
The rental period will begin on the date specified in the quote and will continue until the end date stated, unless terminated earlier according to these terms. The first date of the rental will be the calendar date when the AED units are retrieved by the customer and the last date will be when the AED units are returned to Do CPR. Any additional days for pick up/return will be charged according to the Rental Rates in Section 3.
3. Rental Rates
Daily Rate: $25 per day (24 hours)
Monthly Rate: $300 per month (30 days) Rental charges are due in full before the rental period starts, unless otherwise agreed in writing. Late returns will incur additional charges at a rate of $50 per day.
4. Equipment Condition and Maintenance
The Lessee agrees to maintain the Equipment in good working order and return it in the same condition as it was received, except for normal wear and tear. Any damage or malfunctions must be reported to the Lessor immediately.
Lessee is responsible for ensuring the Equipment is stored, maintained, and used according to the manufacturer’s instructions during the rental period.
5. Equipment Functionality and Liability Limitation
Do CPR, LLC takes every precaution to ensure the Equipment is in full working condition at the time of rental, including routine maintenance and functional testing. However, Lessor does not guarantee that the Equipment will operate without malfunction and is not liable for any losses, damages, injuries, or deaths resulting from any Equipment failure, malfunction, or improper use, unless the issue is due to the Lessor’s gross negligence or willful misconduct.
Lessee assumes all risks associated with the operation of the Equipment and acknowledges that proper functioning may depend on factors beyond Lessor’s control (e.g., environmental conditions or proper usage).
6. Indemnification
Lessee agrees to indemnify, defend, and hold harmless Do CPR, LLC and its employees, officers, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorney fees) arising from:
Misuse or improper operation of the Equipment;
Use of the AED by unauthorized or untrained individuals;
Any injury, death, or property damage caused by the improper or inappropriate use of the AED.
This indemnification applies even in cases of negligence on the part of Lessor, except where the claim arises solely from Lessor’s gross negligence or willful misconduct.
7. Termination and Return
Do CPR, LLC reserves the right to terminate the rental agreement at any time if Lessee fails to comply with the terms and conditions. In such cases, Lessee must immediately return the Equipment.
At the end of the rental period, Lessee must return the Equipment to Do CPR, LLC in proper working condition. Any Equipment not returned within 24 hours of the end of the rental period will incur additional daily charges.
8. Pick-Up and Shipping
Lessee has the following options for obtaining the AED:
Pick-Up: Lessee may pick up the Equipment at a location and time mutually agreed upon in advance with Do CPR, LLC. Arrangements for pick-up must be made before the rental period begins.
Shipping: Do CPR, LLC can arrange for the Equipment to be shipped to the Lessee’s address provided in the quote. Lessee agrees to cover all shipping costs, including both the initial shipment and return shipment. Lessee is responsible for ensuring the Equipment is properly packaged for return shipment. Any damage or loss that occurs during shipping that is not covered by insurance is the responsibility of the Lessee.
8. Governing Law
These terms and conditions are governed by the laws of the State of Iowa.
